Judicial Panel to Reconsider Ruling That Permitted Trump to Deploy Military Forces to Oregon City

The federal appeals court has upheld a ban on deploying national guard in Portland, Oregon, following a recent legal decision.

Judicial Panel Concurs to Reconsider Legal Matter

The ninth circuit court of appeals ruled on this week that it would reexamine the legal dispute concerning the president’s authority with an expanded panel of eleven justices. The court also vacated a earlier ruling from a three-judge panel that had sided with the administration.

Legal Saga Over Military Presence

This legal directive represents the most recent turn in a protracted legal battle over whether the administration has the authority and valid reason to deploy national guard forces in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the deployment effort was initiated in response to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that government employees at the ICE facility in south Portland were under attack, while city and state officials assert that local officers have control of the circumstances.

In defiance of characterizations of Portland as “war ravaged”, residents have been posting footage of lush hiking trails and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The Tuesday ruling came after a US district judge in Portland issued two legal injunctions this month – one blocking the federal control of the state troops, and another stopping the use of any military personnel in Oregon, after attempts to evade the initial injunction by mobilizing out-of-state forces.

On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the second ruling remained in place, blocking the physical sending of the forces.

The Tuesday decision means the issue will be heard by the full court – with all decisions under consideration together – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the judicial system are striving to ensure government responsibility. The founding document restricts the president’s power, and local populations cannot be treated as a testing site for unchecked federal authority,” said the state attorney general in a statement.

“The court is sending a clear message: the executive leader cannot send the military into US cities without cause. We will continue defending Oregon’s laws, values, and autonomy as this legal proceeding progresses and our fight continues in the courts.”
